Digital Millennium Copyright Act (“DMCA”) Notice and Takedown Policy

AMS Consulting, LLC (“AMS Consulting”), operator of Ameliareed.com, qualifies as a “Service Provider” under 17 U.S.C. § 512(k)(1) of the Digital Millennium Copyright Act (“DMCA”). As such, AMS Consulting is entitled to certain protections from liability for copyright infringement claims pursuant to the DMCA’s “safe harbor” provisions.

AMS Consulting respects the intellectual property rights of others and requires that all users of Ameliareed.com do the same. In accordance with the DMCA, AMS Consulting has implemented the following Notice and Takedown Policy to address claims of copyright infringement involving content posted on its platform.


Notice of Claimed Infringement

If you believe that content posted on Ameliareed.com infringes your copyright, you may submit a formal notice of claimed infringement (“Notice”) to our Designated Agent. Your Notice must include the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner;

  2. Identification of the copyrighted work(s) claimed to have been infringed;

  3. Identification of the material that you allege is infringing, including the specific URL(s) where such material is located on Ameliareed.com;

  4. Your contact information, including your address, telephone number, and email address;

  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

  6. A statement, made under penalty of perjury, that the information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Example statement:
“I hereby declare, under penalty of perjury, that I have a good faith belief that the use of the material described above is not authorized by the copyright owner, its agent, or the law, and that the information contained in this notification is accurate.”

Counter-Notification Procedure

If you believe that material removed or disabled as a result of a DMCA Notice was removed in error or due to misidentification, you may submit a counter-notification pursuant to 17 U.S.C. § 512(g)(2)-(3). Your counter-notification must include the following:

  1. A description of the material that was removed or disabled and its location on Ameliareed.com prior to removal (including the specific URL(s));

  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled by mistake or misidentification;

  3. Your full name, physical address, telephone number, and email address;

  4. A statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you reside outside the U.S., for any judicial district where AMS Consulting may be found); and

  5. A statement that you agree to accept service of process from the party who submitted the original Notice or that party’s agent.

Example statement:
“I swear, under penalty of perjury, that I have a good faith belief that the material described above was removed or disabled as a result of mistake or misidentification.”
